1. INTRODUCTORY PROVISIONS
<\/b><\/h2>
  • The online store, available at www.biancomolina.shop, is operated by Molina Klompe j.d.o.o., with its registered office at \u0160trosmajerov trg 9, Jastrebarsko, Croatia (which is also the address for correspondence).\n\nThe company is registered with the Commercial Court in Zagreb under registration number (MBS): 5834147.\n\nEmail: office@biancomolina.com \nPhone: +385 91 983 84 84 (calls are charged according to the rates agreed between the customer and their chosen telecommunications provider).<\/li>
  • To use the online store without any issues, customers must have an IT system that meets the technical requirements of the online store.<\/li>
  • These terms apply to individuals and businesses who use the online store or electronic services, or enter into purchase agreements.
    These Terms also serve as pre-contractual information where the purchase agreement is entered into by a consumer.<\/li>
  • Acceptance of these Terms is voluntary, but required to create an account or make a reservation.<\/li><\/ul>

    Whenever the following terms, written in capital letters, are used in these Terms, they shall have the meanings set out below, unless the context clearly requires otherwise:<\/p>

    1. CUSTOMER SERVICE provides assistance with the use of the online store, product information, applicable regulations and current promotions. Customer Service is available on weekdays during the hours stated on the \u201cContact\u201d page of the online store. Customers can get in touch using the telephone numbers and email address provided there, or by completing the contact form on the same page.\n\nCalls to Customer Service are charged according to the rates agreed between the customer and their chosen telecommunications provider.<\/li>
    2. PRICE \u2013 the gross amount (including VAT), stated in euros (kuna), payable to the Seller for the transfer of ownership of the product to the Customer under the purchase agreement. The Price does not include delivery costs, unless otherwise specified in the terms of a promotional offer on the online store.<\/li>
    3. BUSINESS DAY \u2013 any day from Monday to Friday, excluding public holidays.<\/li>
    4. PASSWORD \u2013 a sequence of alphanumeric characters required for authentication when accessing a user account, chosen by the user during account creation. When registering an account, the user must enter the password twice to identify and correct any errors. The user is responsible for keeping their password confidential and must not disclose it to third parties. The Seller provides customers with the option to change their password.<\/li>
    5. CLIENT \u2013 an individual, a legal entity acting through an authorised representative, or any other entity with full legal capacity. If the Customer is an individual with limited legal capacity, they undertake to obtain legally valid consent from their legal representative before entering into a service agreement or purchase agreement, and to provide such consent at the Seller's request.<\/li>
    6. LAW ON OBLIGATIONS \u2013 Narodne novine 35\/2005, 41\/2008, 125\/2011, 78\/2015 and 29\/2018.<\/li>
    7. CONSUMER \u2013 any individual who enters into a legal transaction or operates in the market for purposes outside their trade, business, craft or profession.<\/li>
    8. USER ACCOUNT \u2013 an electronic service identified by an individual username (login) and password provided by the Customer. It consists of a set of resources within the Seller's IT system that enables the user to access additional features and services. The Customer accesses their User Account using their username (login) and password. After registering with the online store, the Customer can log in to their User Account.\n\nThe account allows the Customer to save and store information, such as the delivery address provided in the order form, track order status, access order history and use other services offered by the Seller.<\/li>
    9. SHOPPING BASKET \u2013 a service available to every Customer using the online store, which allows them to order one or more products, make a reservation and enter discount codes that reduce the price subject to the terms set out in separate agreements or regulations. The Shopping Basket displays a price summary for each product and the total price of all products (including delivery costs, where applicable), as well as the expected delivery date.\n\nThe Customer adds to the Shopping Basket the products they wish to purchase, which will become the subject of a purchase agreement if such an agreement is concluded. A single order may include multiple products.<\/li>
    10. LOGIN \u2013 the email address provided by the Customer when creating a User Account in the online store.<\/li>
    11. NEWSLETTER \u2013 an electronic service that allows Customers who subscribe to receive periodic updates from the Seller, particularly about products and the online store, including new arrivals and promotions. These updates are sent to the email address or phone number provided by the Customer, with their explicit consent. The terms governing the provision of the Newsletter service by the Seller are set out in separate policies available on the online store.<\/li>
    12. PRODUCT \u2013 a movable item offered in the online store that is the subject of a purchase agreement between the Customer and the Seller, provided that it has been paid for or reserved. All products offered in the online store are brand new.<\/li>
    13. PROMOTIONS \u2013 special terms and conditions for the sale of products or provision of services, offered by the Seller for a limited period and advertised on the online store. Customers may benefit from the offers included in such promotions, such as reduced product prices or discounted delivery costs.<\/li>
    14. TERMS \/ SERVICE AGREEMENT \u2013 this document sets out the rules governing the conclusion of purchase agreements and the provision and use of services offered by the Seller to Customers through the online store, including the reservation service. These Terms define the rights and obligations of the Customer and the Seller. The rights and obligations of both parties are governed by the Consumer Protection Act, the Electronic Commerce Act, the EU acquis and these Terms.<\/li>
    15. ONLINE STORE \u2013 a platform that allows Customers to order products and access services offered by the Seller. The online store is operated by the Seller and is available at the following address: www\\.biancomolina.shop.<\/li>
    16. SELLER \u2013 Molina Klompe j.d.o.o., with its registered office at \u0160trosmajerov trg 9, Jastrebarsko, Croatia (which is also the address for correspondence), registered with the Commercial Court in Zagreb under registration number (MBS): 5834147.\n\nEmail: office\\@biancomolina.com Phone: +385 91 578 84 46 (calls are charged according to the rates agreed between the Customer and their chosen telecommunications provider).<\/li>
    17. CONTENT \u2013 text, graphic or multimedia elements (such as product information, product images, promotional videos, descriptions and comments), including images of individuals, that form part of the online store and are distributed by the Seller, the Seller's partners, Customers or other users of the online store, as applicable, in accordance with the Copyright and Related Rights Act.<\/li>
    18. PURCHASE AGREEMENT \u2013 a purchase agreement within the meaning of the Law on Obligations, concerning the sale of a product by the Seller to the Customer in exchange for payment of the purchase price and any additional charges, including delivery costs, the terms of which are set out separately in these Terms.\n\nThe Customer and the Seller enter into the Purchase Agreement by means of distance communication, once the Seller has accepted the order in accordance with the conditions set out in these Terms.\n\nThe Purchase Agreement specifies the product, its main characteristics, the price, delivery costs and other relevant terms. A separate Purchase Agreement is concluded for each product.<\/li>
    19. INFORMATION SOCIETY SERVICE \u2013 electronic services within the meaning of the Electronic Commerce Act, provided by the Seller to the Customer through the online store in accordance with the Service Agreement. Where such services are provided by entities cooperating with the Seller, the relevant provisions governing the use of those services are set out in the terms and conditions issued by those entities.<\/li>
    20. CONSUMER PROTECTION ACT \u2013 Narodne novine 41\/2014, 110\/2015 and 14\/2019. This Act governs the protection of consumers' fundamental rights when purchasing products and services.<\/li>
    21. TECHNICAL REQUIREMENTS \u2013 the minimum technical requirements that must be met to ensure compatibility with the IT system used by the Seller, including for entering into a Service Agreement or Purchase Agreement:\n\n1. A desktop computer, laptop or other multimedia device with internet access (or, in the case of applications, a mobile device);\n2. Access to an email account;\n3. A web browser: Mozilla Firefox version 17.0 or later, Internet Explorer version 10.0 or later, Opera version 12.0 or later, Google Chrome version 23.0 or later, or Safari version 5.0 or later;\n4. Recommended minimum screen resolution: 1024 \u00d7 768 pixels;\n5. Cookies and JavaScript support enabled in the web browser;\n6. A telephone, where a Purchase Agreement is concluded by phone or an application is used.\n\nTo enter into a Purchase Agreement, the Customer must have an active email address and, in certain cases, a keyboard or another device that enables them to complete electronic forms correctly.<\/li>
    22. ORDER \u2013 a declaration by the Customer expressing their free and voluntary intention to enter into a distance purchase agreement by means of distance communication. The Order identifies the product for which the Customer submits an offer to enter into a Purchase Agreement, as well as the Customer's details required for the potential conclusion and fulfilment of the Purchase Agreement.\n\nEach product order shall be treated as a separate offer by the Customer to enter into a Purchase Agreement. This means that, in the event of a complaint or return concerning a particular product, the Customer is not required to return all products included in the order, but only the product to which the complaint relates.<\/li>
    23. MOLINA KLOMPE j.d.o.o. AFFILIATE \u2013 an individual or legal entity that is economically, organisationally or financially affiliated with Molina Klompe j.d.o.o.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

      2. INFORMATION SOCIETY SERVICES PROVIDED THROUGH THE ONLINE STORE<\/b><\/h2>

      The Seller provides the following services to Customers free of charge:
      a. User Account,
      b. enables Customers to place orders for products and enter into Purchase Agreements, subject to the terms set out in these Terms;
      c. providing personalised advertising content to Customers;
      d. enabling Customers to use the Shopping Basket service;
      e. enabling Customers to browse the content available on the online store;
      f. Newsletter;<\/p>

      In addition, the Seller provides the following services free of charge through the online store to Customers who have created a User Account:
      a. maintaining the Customer's session after they log in to their User Account (via a web browser);
      b. access to order and reservation history through the User Account.
      The User Account can be used once the Customer has completed the following steps:
      a. completing the registration form and accepting the provisions of these Terms;
      b. clicking the \u201cRegister\u201d button.
      The Service Agreement is concluded when the Customer receives confirmation of its conclusion, sent by the Seller to the email address provided by the Customer during registration.\n\nUse of the User Account is free of charge and has no time limit. The User may delete their User Account at any time and for any reason by submitting a request to the Seller, in particular by email to office\\@biancomolina.com or in writing to the following address: \u0160trosmajerov trg 9, Jastrebarsko, Croatia.\n\nCreating a User Account is not required to place an order or make a reservation through the online store.<\/p>

      The Customer begins using the Shopping Basket by adding the first product to it.<\/p>

      The Shopping Basket is provided free of charge and is a one-off service that ends when an order or reservation is placed, or when the Customer stops using it to place orders or make reservations.\n\nThe Shopping Basket retains information about the products selected by the Customer for up to 7 days, even after the browser or application session has ended, including after the Customer has logged out. However, this does not guarantee that the selected products will remain available for purchase or reservation at a later date.\n\nIf the Shopping Basket is used by a Customer logged in to their User Account via a web browser, its contents will be synchronised with the User Account.<\/p>

      The Customer specifically undertakes to:
      a. provide only truthful and complete personal information in forms and throughout the online store;
      b. promptly and responsibly update any information, including personal data, provided to the Seller in connection with the conclusion of a Service Agreement or Purchase Agreement, particularly where necessary for the proper fulfilment of such agreements. The Customer may change the information provided when creating their User Account at any time using the options available within the account;
      c. use the Seller's services and features in a manner that does not disrupt the operation of the Seller, the online store or the application;
      d. use the services and features made available by the Seller in accordance with applicable laws, mandatory legal provisions and accepted standards of conduct;
      e. use the services and features provided by the Seller in a manner that does not inconvenience other Customers or the Seller;
      f. pay the full purchase price and any other charges agreed between the Customer and the Seller on time;
      g. collect the ordered products promptly and pay for them upon delivery;
      h. refrain from providing or making available through the online store any content prohibited by law, particularly content that infringes the intellectual property rights or personal rights of third parties;
      i. refrain from engaging in activities such as:<\/p>

      • sending or making unsolicited commercial communications available through the online store, or posting any content that violates applicable laws (including illegal content);<\/li>
      • engaging in IT-related or any other activities aimed at obtaining information not intended for the Customer, including other Customers' data, or interfering with the rules or technical aspects of the online store's operation, registration or payment processing;<\/li>
      • making unauthorised changes to content provided by the Seller, particularly product prices or descriptions displayed in the online store;<\/li><\/ul>

        Complaints relating to the provision of electronic services may be submitted, for example, by:
        a. in writing to the following address: \u0160trosmajerov trg 9, Jastrebarsko, Croatia;
        b. electronically, by email to: office\\@biancomolina.com.<\/p>

        Customers are advised to include the following information when submitting a complaint: (1) details and circumstances relating to the subject of the complaint, particularly the type and date of the issue; (2) the Customer's requested resolution; and (3) the contact details of the person submitting the complaint. Providing this information will help the Seller review the complaint more easily and promptly.\n\nThe requirements set out in the previous sentence are recommendations only and do not affect the validity of any complaint submitted. We will consider your complaint regardless of whether you have followed our recommendations regarding its content.<\/p>

        The Seller will respond to the complaint promptly and no later than 15 days from the date of receipt, in accordance with Article 10(5) of the Consumer Protection Act, unless a different deadline is prescribed by applicable law or specific regulations.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

        3\\. PRODUCT PRICES<\/b><\/h2>

        In accordance with the Consumer Protection Act, the Seller undertakes to display the retail price clearly, visibly and legibly.
        All prices displayed in the online store are stated in euros (kuna) and include VAT. The Seller is registered for VAT purposes.
        The prices displayed do not include delivery costs, which are charged separately (details are provided in the online store).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

        4. TERMS AND CONDITIONS FOR ENTERING INTO PURCHASE AGREEMENTS<\/b><\/h2>

        Customers may make purchases through the Seller's online store either as guests or as registered users. Products are ordered by completing an electronic order form. Products are deemed to have been ordered once the Customer has completed the ordering process. Products may be paid for by cash on delivery or by bank transfer (using a standard payment slip).<\/p>

        The Order shall be deemed to have been received:
        In the case of payment by bank transfer \u2013 once the Seller has received the Order electronically.
        In the case of cash on delivery \u2013 once the Seller has received the Order electronically.
        Upon receipt of the Order, the Seller will notify the Customer by email that the Order has been received.
        Where the Customer pays for the Products by bank transfer, the Purchase Agreement shall be deemed to have been concluded once the Seller receives confirmation of payment.
        Where payment for the ordered Product is made by bank transfer, the Seller undertakes to reserve the Product for a period of 3 Business Days. After 3 Business Days have elapsed from receipt of the Order, the Seller does not guarantee that the Product will remain available.<\/p>

        \u2013 Where it is not possible to accept all or some of the offers submitted as part of an Order, Customer Service will contact the Customer in order to:
        a. inform the Customer that it is not possible to accept all the offers submitted as part of the Order to enter into a Purchase Agreement; or
        b. obtain the Customer's consent to proceed with the Order in respect of the part for which the Seller has agreed to accept the offer to enter into a Purchase Agreement. In this case, the Customer may cancel the entire Order (in respect of all offers), without affecting their right to withdraw from the Purchase Agreement. Cancellation of the Order by the Customer releases the Seller from the obligation to fulfil it. In the event of cancellation of the Order,<\/p>

        \u2013 Where it is not possible to accept the offer or offers submitted as part of the Order, no Purchase Agreement shall be concluded in respect of the Product or Products identified by Customer Service. The Seller shall refund to the Customer, without undue delay and no later than within 14 days, any amount paid in respect of which no Purchase Agreement has been concluded.
        The Seller endeavours to ensure that Products are available and that Purchase Agreements can be fulfilled. Where fulfilment becomes impossible, or in other circumstances involving force majeure, the relevant provisions of the Law on Obligations shall apply.<\/p>

        \u2013 The total Order value includes the Price, delivery costs and any other charges for additional, optional services selected by the Customer. The Seller may set a minimum Order value above which delivery of Products is free of charge.\n\nThe Customer shall be informed of the total price, including taxes applicable to the Products included in the Order, delivery costs (including transport and postal charges) and any other costs (for example, the cost of redirecting a shipment if the Customer changes the delivery address after placing the Order). Where the amount of such costs cannot be determined in advance, the Customer shall be informed, during the ordering process and when expressing their intention to enter into the Purchase Agreement, that they may be required to pay such costs.<\/p>

        \u2013 Promotions available in the online store cannot be combined unless expressly stated otherwise.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

        5. PRODUCT PAYMENT METHODS AND DEADLINES<\/b><\/h2>

        The Seller offers the Customer various payment methods under the Purchase Agreement.
        The payment methods currently available are listed in the online store under the \u201cPayment Methods\u201d tab and on each individual Product page, including when the Customer wishes to enter into a Purchase Agreement.<\/p>

        The currently available payment methods are:<\/p>

        • Cash on delivery<\/li>
        • Electronic payment by bank transfer using a payment slip<\/li><\/ul>

          Electronic payment of the Order amount is processed through authorised payment service providers, in accordance with the Customer's chosen payment method.<\/p>

          If the Seller does not receive payment from a Customer who has selected an advance payment method, i.e. payment by bank transfer or electronic payment, Customer Service may contact the Customer to remind them to make the payment, including by sending an email.\n\nIf the Customer fails to make the payment within 3 days of placing the Order, the offer submitted by the Customer by placing the Order shall not be accepted.\n\nThe Customer may also cancel the Order without any consequences at any time before receiving the dispatch notification by contacting the Seller through Customer Service. This does not affect the Customer's right to withdraw from the Purchase Agreement. However, this does not apply where the subject of the Purchase Agreement is goods made to the Consumer's specifications or clearly personalised to the Consumer.
          If the Customer selects cash on delivery, they are required to make payment upon receipt of the delivery. Refusal to accept the Products, despite having been given an additional reasonable period to do so, shall constitute grounds for termination of the Purchase Agreement.\n\nThe Customer may also cancel the Order within the specified period without incurring any consequences. This does not affect the Customer's right to withdraw from the Purchase Agreement. However, this does not apply where the subject of the Purchase Agreement is goods made to the Consumer's specifications or clearly personalised to the Consumer.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

          6. DOSTAVA<\/b><\/h2>

          Dostava proizvoda dostupna je na teritoriju Republike Hrvatske.
          Proizvodi se \u0161alju putem dostavne slu\u017ebe GLS. Paketi se dostavljaju isklju\u010divo radnim danom, od ponedjeljka do petka, na navedenu adresu dostave.
          Sve narud\u017ebe\/uplate koje su zaprimljene tokom radnog dana do 12:00h obra\u0111uju isti dan, a isporu\u010duju u roku 2-5 radna dana izme\u0111u 8 i 20 sati. Dostava na otoke odvija se prema rasporedu dostavne slu\u017ebe.
          Tro\u0161ak dostave pla\u0107a kupac, a u cijenu je uklju\u010deno pakiranje proizvoda.
          Dostava iznosi\u00a0<\/p>

          • Postarina sa pla\u0107anjem pouze\u0107em – 6,20 \u20ac<\/li>
          • Postarina preuzimanja paketa na paketomatu – 3,95 \u20ac<\/li><\/ul>

            Prodavatelj je obvezan isporu\u010diti naru\u010deni proizvod u roku 15 dana od dana sklapanja ugovora.
            Osobno preuzimanje proizvoda nije mogu\u0107e. Prodavatelj proizvode isporu\u010duje isklju\u010divo putem dostavne slu\u017ebe.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

            7. REKLAMACIJA I POVRAT PROIZVODA<\/b><\/h2>

            Kupac ima pravo prigovora i povrata po\u0161iljke:
            \u2022 ukoliko je zaprimio po\u0161iljku koja ne odgovara narud\u017ebi;
            \u2022 ukoliko je zaprimio po\u0161iljku s nenaru\u010denim proizvodom.<\/p>

            Prigovori se \u0161alju: e-mailom na\u00a0 office@biancomolina.com ili na adresu\u00a0 Molina Klompe j.d.o.o., \u0160trosmajerov trg 9, Jastrebarsko.\u00a0 Prodavatelj \u0107e pismeno potvrditi primitak prigovora i odgovoriti u najkra\u0107em roku, a najkasnije u roku 15 dana od zaprimanja prigovora (sukladno Zakonu o za\u0161titi potro\u0161a\u010da).<\/p>

            U slu\u010daju opravdanog prigovora, kupac ima pravo na raskid ugovora, povrat pla\u0107enog iznosa ili na zamjenu proizvoda. U slu\u010daju zamjene proizvoda kupac snosi tro\u0161kove nove po\u0161iljke, a tro\u0161ak povrata preuzima Prodavatelj.
            Prodavatelj \u0107e prihvatiti povrat svih gore navedenih proizvoda o svom tro\u0161ku, ukoliko se utvrdi da je prigovor opravdan i da u kupca ne postoji nikakva odgovornost.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

            8. Neispravne po\u0161iljke, materijalni nedostaci proizvoda<\/b><\/h2>

            Prodavatelj je odgovoran za materijalne nedostatke proizvoda koje prodaje putem web-trgovine, u skladu s pozitivnim zakonima Republike Hrvatske, posebno sa Zakonom o obveznim odnosima.<\/p>

            Naru\u010deni proizvodi pakiraju se i sla\u017eu na na\u010din da se redovitim rukovanjem u dostavi ne o\u0161tete. U slu\u010daju po\u0161iljke vidljivo o\u0161te\u0107ene u transportu, kupcima se savjetuje da istu ne preuzimaju. Mole se kupci da kontaktiraju Prodavatelja radi prevladavanja mogu\u0107ih te\u0161ko\u0107a.
            Kupac je slobodan odbiti primitak proizvoda o\u0161te\u0107enog u transportu i ne\u0107e biti tere\u0107en za tro\u0161kove dostave.<\/p>

            Kupac je du\u017ean provjeriti ispravnost narud\u017ebe, uspore\u0111uju\u0107i primljene proizvode s ra\u010dunom. Ukoliko ne\u0161to nedostaje obvezan je u roku osam dana uputiti pisani prigovor Prodavatelju. Naknadne reklamacije ne\u0107e se uva\u017eiti.<\/p>

            Potpisom potvrde o primitku po\u0161iljke kupac potvr\u0111uje da nema prigovora na dostavljene proizvode.
            Odbijanjem primitka neispravne po\u0161iljke, dostavna slu\u017eba \u0107e po\u0161iljku vratiti Prodavatelju. U slu\u010daju skrivenog nedostatka proizvoda, a \u0161to kupac mo\u017ee utvrditi tek uvidom u proizvod, omogu\u0107uje mu se jednostrani raskid ugovora i povrat novca, zamjena proizvoda ili umanjenje cijene.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

            9. IZVANSUDSKE METODE RAZMATRANJA REKLAMACIJA I PRAVILA POSTUPANJA U OVIM POSTUPCIMA<\/b><\/h2>

            Kori\u0161tenje izvansudskog postupka razmatranja reklamacije i potra\u017eivanje naknade \u0161tete je dobrovoljno. Sljede\u0107e su odredbe informativnog karaktera i ne predstavljaju obvezu prodavatelja za kori\u0161tenje izvansudskog rje\u0161avanja sporova. Izjavu o pristanku ili odbijanju sudjelovanja u postupku izvansudskog rje\u0161avanja potro\u0161a\u010dkih sporova prodavatelj donosi u pisanom obliku ili drugom trajnom mediju u slu\u010daju da nakon prigovora potro\u0161a\u010da spor nije rije\u0161en.<\/p>

            Kupac koji je potro\u0161a\u010d ima sljede\u0107e mogu\u0107nosti kori\u0161tenja izvansudskih postupaka razmatranja i ostvarenja svojih prava:
            a. Rje\u0161avanje sporova je mogu\u0107e pred Sudom \u010dasti HGK ili drugim tijelima za mirenje,
            b. Kupac mo\u017ee podnijeti \u017ealbu putem internetske platforme ODR: http:\/\/ec.europa.eu\/consumers\/odr\/. ODR platforma je tako\u0111er izvor informacija o oblicima izvansudskog rje\u0161avanja sporova koji se mogu pojaviti izme\u0111u poduzetnika i potro\u0161a\u010da.
            Potro\u0161a\u010di mogu vi\u0161e informacija o svojim pravima i na\u010dinima ostvarivanja istih saznati na stranicama tijela koja pru\u017eaju pomo\u0107 i savjetodavne usluge potro\u0161a\u010dima u Republici Hrvatskoj, kao \u0161to su:
            a. Europski potro\u0161a\u010dki centar Republika Hrvatska http:\/\/ecc-croatia.hr\/
            b. Hrvatska udruga za za\u0161titu potro\u0161a\u010da http:\/\/www.huzp.hr\/

            Komisija Europske unije uvela je pravila o digitalnim ugovorima radi pojednostavnjenja i promicanja pristupa digitalnom sadr\u017eaju i internetskoj prodaji diljem EU-a, a novom internetskom platformom sada se ja\u010da povjerenje u kupnju putem interneta te tako daje va\u017ean doprinos strategiji jedinstvenog digitalnog tr\u017ei\u0161ta EU-a.

            10. PRAVO NA JEDNOSTRANI RASKID UGOVORA<\/b><\/h2>

            Obrazac za jednostrani raski ugovora mo\u017eete preuzeti na dnu stranice.
            Sukladno Zakonu o za\u0161titi potro\u0161a\u010da, kupac ima pravo na jednostrani raskid ugovora, bez navo\u0111enja razloga, u roku 14 dana od dana primitka narud\u017ebe.<\/p>

            Kako bi ostvario pravo na jednostrani raskid ugovora, kupac je o tome du\u017ean obavijestiti\u00a0 Prodavatelja i to nedvosmislenom izjavom poslanom po\u0161tom ili e-mailom, u kojoj \u0107e navesti svoje ime i prezime, adresu stanovanja, broj telefona i e-mail adresu.
            a. u pisanom obliku na adresu: Molina Klompe j.d.o.o., \u0160trosmajerov trg 9, Jastrebarsko;
            b. u elektroni\u010dkom obliku putem e-maila na adresu: officec@biancomolina.com;
            c. pomo\u0107u obrasca za odustajanje koji je prilo\u017een kao Prilog ovim Pravilima.<\/p>

            Prodavatelj \u0107e potvrditi primitak i obavijesti o jednostranom raskidu.
            Rok za jednostrani raskid ugovora od 14 dana po\u010dinje te\u0107i od dana kada je kupcu predana u posjed roba koja \u010dini predmet ugovora ili tre\u0107oj osobi odre\u0111enoj od strane kupca, a koja nije prijevoznik.
            Ukoliko kupac jednostrano raskine ovaj ugovor, Prodavatelj se obvezuje izvr\u0161iti povrat primljenog novca, bez odgode, a najkasnije u roku 14 dana od dana povrata robe ili nakon dostavljenog dokaza da je roba poslana.
            Povrat novca vr\u0161i uplatom na teku\u0107i ra\u010dun kupca. Kupac je du\u017ean robu poslati bez odga\u0111anja, najkasnije u roku od 14 dana od dana kada je uputio svoju odluku o jednostranom raskidu.
            Tro\u0161kove povrata robe snosi kupac.
            Kupac je odgovoran za svako umanjenje vrijednosti robe koje je nastalo kao rezultat rukovanja robom, osim onog koje je bilo potrebno za utvr\u0111ivanje prirode, obilje\u017eja i funkcionalnosti robe.<\/p>

            Potro\u0161a\u010d mo\u017ee koristiti obrazac za odustajanje, ali nije obvezan.
            U slu\u010daju kori\u0161tenja prava na jednostrani raskid ugovora na daljinu, ugovor se smatra raskinutim.
            Potvrdu primitka izjave o jednostranom raskidu ugovora prodavatelj \u0107e dostaviti potro\u0161a\u010du bez odga\u0111anja, na fizi\u010dku adresu ili adresu e-po\u0161te. U slu\u010daju raskida ugovora, svaka je strana du\u017ena vratiti drugoj strani ono \u0161to je primila na temelju ugovora.
            Prodavatelj nije u obvezi izvr\u0161iti povrat dodatnih tro\u0161kova koji su rezultat potro\u0161a\u010deva izri\u010ditog izbora vrste prijevoza koji je razli\u010dit od najjeftinije vrste standardnog prijevoza koji je ponudio prodavatelj.
            Prodavatelj mora izvr\u0161iti povrat pla\u0107enoga slu\u017ee\u0107i se istim sredstvima pla\u0107anja kojim se koristio Potro\u0161a\u010d prilikom pla\u0107anja, osim ako potro\u0161a\u010d izri\u010dito ne pristane na neko drugo sredstvo pla\u0107anja, te uz pretpostavku da potro\u0161a\u010d ne bude obvezan platiti nikakve dodatne tro\u0161kove za takav povrat. U slu\u010daju da se sredstva ne mogu vratiti istim na\u010dinom pla\u0107anja koji je koristio Potro\u0161a\u010d zbog toga \u0161to Prodavatelj vi\u0161e ne podr\u017eava odre\u0111eni na\u010din pla\u0107anja, Prodavatelj \u0107e izvr\u0161iti povrat sredstava koriste\u0107i na\u010din pla\u0107anja koji \u0107e u najve\u0107oj mogu\u0107oj mjeri odgovarati svojstvima na\u010dina pla\u0107anja koji je prethodno koristio Potro\u0161a\u010d.
            Potro\u0161a\u010d je du\u017ean odmah, najkasnije u roku od 14 dana od dana odustajanja od kupoprodajnog ugovora, vratiti proizvod prodavatelju. Potro\u0161a\u010d mo\u017ee vratiti proizvod na sljede\u0107u adresu: Molina Klompe j.d.o.o., \u0160trosmajerov trg 9, Jastrebarsko.
            Sve tro\u0161kove povrata proizvoda potro\u0161a\u010d je du\u017ean snositi sam.
            Potro\u0161a\u010d je odgovoran za svako umanjenje vrijednosti robe koje je rezultat rukovanja robom osim onog koje je bilo potrebno za utvr\u0111ivanje prirode, obilje\u017eja i funkcionalnosti proizvoda.
            Kako bi potro\u0161a\u010d utvrdio prirodu, obilje\u017eja i funkcionalnosti robe isti mo\u017ee postupati sa robom i pregledati robu isklju\u010divo na na\u010din na koji je to uobi\u010dajeno pri kupnji robe u prostorijama prodavatelja. Robu koju kupac namjerava vratiti u roku od 14 dana isti ne smije prepravljati, koristiti, niti smije poduzimati osobito bilo koje radnje koje se ne smiju poduzimati u fizi\u010dkoj poslovnici prodavatelja, kao i one kojima bi umanjio vrijednost robe.
            U slu\u010daju umanjenja vrijednosti proizvoda koje je rezultat rukovanja proizvodom prodavatelj \u0107e se naplatiti iz iznosa primljene kupoprodajne cijene u omjeru umanjenja vrijednosti robe prema vlastitoj procjeni uzimaju\u0107i u obzir objektivne kriterije svakog pojedinog slu\u010daja.
            Pravo na jednostrani raskid ugovora o kupoprodaji nije dopu\u0161teno u sljede\u0107im slu\u010dajevima kada je:
            a. ugovor o uslugama trgovac u potpunosti ispunio, a ispunjenje je zapo\u010delo uz izri\u010dit prethodni pristanak potro\u0161a\u010da te uz njegovu potvrdu da je upoznat s \u010dinjenicom da \u0107e izgubiti pravo na jednostrani raskid ugovora iz ovoga odsjeka ako usluga bude u potpunosti ispunjena;
            b. predmet ugovora roba koja je izra\u0111ena po specifikaciji potro\u0161a\u010da ili koja je jasno prilago\u0111ena potro\u0161a\u010du;
            c. predmet ugovora zape\u010da\u0107ena roba koja zbog zdravstvenih ili higijenskih razloga nije pogodna za vra\u0107anje, ako je bila otpe\u010da\u0107ena nakon dostave;
            d. predmet ugovora roba koja je zbog svoje prirode nakon dostave nerazdvojivo pomije\u0161ana s drugim stvarima.<\/p>
